The Family of Shaheen Mackey posted Mackey's now-viral video taken inside the Luzerne County Correctional Facility on June 6, 2018. Mackey of Berwick, Pa, died two days after the video was filmed.
In June 2020, Luzerne County settled a $3 million civil lawsuit with the family of Shaheen Mackey after they alleged correctional and medical personnel at the Luzerne County Correctional Facility failed to respond to Mackey after he had a seizure while in custody adequately.
In the autopsy report for Shaheen Mackey, a forensic pathologist states that Mackey passed away from natural causes. His family says it's evident in the video what caused his death.
Luzerne County Manager David Pedri said, "It was heartbreaking to watch the footage inside LCCF and learn of Mr. Mackey's passing subsequently. As soon as we learned of the incident, we referred the matter to the district attorney."
In November of 2019, the district attorney's office ruled no wrongdoing happened during the case, and no charges would be submitted and still stands by that.
Mackey's family argues instead of effectively resolving their loved one's epilepsy; he was yelled at, physically restrained, tased several times, and not properly cared for.
"You see the video, but you don't see the crime that's being committed, how? I don't know how because it's right there. It's clear, it's clear. How could you go around that for two years?" Says Mackey's daughter Tatiyanee.
Mackey's family is upset that the Luzerne County Coroner's office ruled that Mackey died from "natural causes," and the DA's office has ruled that no wrongdoing happened in handling the event. The DA continues to stands by that ruling.
